OVERVIEW
Australian Wine & Food supports the responsible service of alcohol. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. Liquor licence number 36056164
ORDERS
As of 30/09/2020 all orders received during the week up until 12 midnight on a Thursday will be packaged the next day on a Friday. Orders will then be collected the following Monday for delivery to our customers. All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers. We seek to only offer products for sale that are in stock and available for dispatch within a reasonable period of time. Occasionally however, we may be waiting for additional stock from our suppliers. Should this occur, we shall seek to notify you of the expected delivery date and you will be given the opportunity to refund your purchase if so desired.
ACCEPTANCE OF YOUR ORDER
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it. Unless you cancel your order, acceptance of your order and completion of the contract between you and Australian Wine & Food P/L will be completed when the goods have been dispatched.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the terms of service.
We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
DELIVERY
We utilise a network of courier companies that may change from time to time depending upon your location and the location of the supplier. In order to comply with liquor laws an adult over the age of 18 years must be present to accept the delivery and may be required to present appropriate identification. If you're not present at the time of delivery, the courier company may elect to leave the products at your address or you may have to pick up from your local post office or alternative parcel pick-up point as notified by the courier company. You may provide specific delivery instructions, including authorisation for the products to be left at your address, during the checkout process.
Unless the purchaser expressly provides to the contrary, the purchaser requests the seller to deliver the goods to the purchaser. Any delivery timeframes specified by us are indicative only. We are not liable for any loss or damage that you may suffer if delivery is not made within the delivery timeframes or it is delayed for any reason.
Please note that we can’t deliver produce outside of Australia at this point in time. We‘re also not obliged to deliver the goods to a location where our nominated contractor or agent does not provide delivery services. The person we deliver to has to be aged 18 years or over (and may be asked to provide proof of age). If no-one is at the delivery address, or if there is no-one aged 18 or over, an attempted delivery notice will be left at the delivery address and you will need to collect your product from the location specified in the notice. RETURNS, EXCHANGES & REFUNDS
In the event you receive goods that are damaged or faulty, please contact us within 20 days of receiving your order and we will refund the value of the damaged goods. We reserve the right to require proof that the goods were damaged or faulty.
Refunds will be debited onto the credit card used to make the purchase. We will seek to process your refund as quickly as possible, but please allow up to 7 business days for your refund to be processed. Faulty products, if a product you have purchased from Australian Wine & Food P/L is faulty, damaged (excluding damage caused by misuse), wrongly described or breaches a consumer guarantee, we will refund your money, exchange or, where possible, repair the product.
We will ask you for a valid proof of purchase when returning a faulty product. Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
Please contact us to let us know to expect your return and return your goods to Australian Wine & Food P/L, PO Box 7305, Shepparton, Victoria, 3632. We may not accept returns if they are received damaged or incomplete.
OUR REFUNDS POLICY
If you have cancelled an order, we will process any refund due to you within 7 days of the day you gave notice of cancellation. In this case, we will refund the price of the product in full, and any applicable delivery charges. However, you will be responsible for the cost of returning the product to us. If you seek a refund for any other reason, you can request a refund by email to dale@australianwineandfood.com.au and we will consider each request at our reasonable discretion. We will notify you of the outcome of your refund request via email within 7 days. If your refund is approved, we will process the refund within 7 days of the day we confirmed to you via email that you were entitled to a refund. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. Please take care when specifying your delivery address as refunds will not be provided for if you enter an address incorrectly.
RETURN SHIPPING
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. For additional information in this section, create your own Return & Refund Policy.
CANCELLATIONS & RETURNS
Once you have placed an order, please note that we are unable to cancel or edit your order. Accordingly, please ensure all product and delivery details are correct.
In the unlikely event that the goods received are faulty or defective, not as ordered or not of acceptable quality of Schedule 2 to the Competition and Consumer Act 2010, please contact us on dale@australianwineandfood.com.au and we will attempt to remedy the situation as soon as possible. If we are unable to supply you with wine of the vintage that you ordered, we reserve the right to substitute it for the same wine of a different vintage.
CONDITIONS OF SALE
The following terms apply to any orders and purchases you make from this Australian Wine & Food P/L website.
You must not order or purchase alcoholic goods from us if you are aged under 18, for re-sale purposes (all goods must be purchased for personal use), or which are outside any order limits or restrictions which we may apply to our beverages on this site.
We may accept any order for the supply of goods (in whole or in part), or decline any order. We are not liable to you in respect of those goods that we are unable to supply to you, provided that we refund any amounts paid by you in respect of the unsupplied goods.
CHANGE OF DETAILS
Changes to address details and/or delivery instructions must be communicated via the methods and by the cut-offs outlined in these Terms and Conditions.
We are not liable for any charges you incur as a result of out of date payment information. If we incur an expense due to incorrect payment information provided by you, we reserve the right to seek reimbursement from you for such expense.
PAYMENT
Payment can be made by Visa, MasterCard and American Express cards and any other methods which may be clearly advertised on the Site from time to time. Payment will be debited and cleared from your account upon dispatch of your order by Australian Wine & Food P/L. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Australian Wine & Food P/L, we will not be liable for any delay or non-delivery.
We take reasonable care to make our site secure. All credit/debit card transactions on this site are processed using secure online payment gateway that encrypts your card details in a secure host environment. With the combination of SSL encryption on our website and a secure browser at your end, we take all reasonable measures to ensure that your credit card and personal information are protected when you purchase online.
COLLECTION OF FINANCIAL INFORMATION
Australian Wine & Food P/L does not collect or store payment information. All payment information is collected and stored by the applicable third-party in order to be processed as required. We never permanently store complete debit/credit card details. All online debit/credit card transactions performed on this Site are through secured payment gateways. Complete debit/credit card details cannot be viewed by Australian Wine & Food P/L or any outside party. Payments will appear on your bank statement as Australian Wine & Food in your PayPal account.
FAILED PAYMENTS
Payment failures may be due to insufficient funds, incorrect or outdated payment information, and transaction disputes. If we are unable to debit your payment method your product may still be dispatched, and the sale will be deemed to have occurred. In such instances Australian Wine & Food P/L will re-attempt the payment process. We reserve the right to re-attempt payment on the nominated payment method to recover any outstanding amounts. In the event that payment re-attempts are unsuccessful we reserve the right to recover the debt through alternative means, either directly or through a third-party. We reserve the right to suspend or terminate future deliveries when payments are outstanding. If you fail to settle outstanding amounts within ten days of the order cut-off date a late payment fee may apply.
DEBT COLLECTION
You acknowledge that we may pursue and attempt to collect any outstanding amounts as a result of any declined and outstanding payments on your account. You agree and allow us to contact you to discuss those failed payments. If we are unable to receive or gain any satisfactory guarantee for payment, your name, contact information, and order details may be referred to an external debt collection agency. You will be liable for any fees or charges incurred as a result of this referral.
RISK AND TITLE
The Products will be at your risk from the time of delivery to the Delivery Address or in accordance with your delivery instructions. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
FORCE MAJEURE EVENTS
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by events outside our control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) strikes, lock-outs or other industrial action;
(b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
(c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
(e) impossibility of the use of public or private telecommunications networks;
(f) epidemic, pandemic or other health emergency (whether declared or not); and
(g) the acts, decrees, legislation, regulations or restrictions of any government.
Our performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these Terms and Conditions may be performed despite the Force Majeure Event.
